Probate
Probate is the legal process for handling a person’s estate after they pass away. It ensures that their possessions are distributed properly—either based on their will or, if there is no will, according to state law—with oversight from the court to make sure everything is done correctly and fairly.
Common Probate Situations:
- There is no will so the state determines how assets are distributed.
- Family members may disagree about how the estate should be handled.
- Identifying and valuing all property can take time and effort.
- Debts and bills must be resolved before assets can be distributed.
- The person handling the estate may feel unprepared or overwhelmed.
- The probate process can take several months or longer.
- Some estates may have tax obligations that need to be addressed.
- Property located in another state may require additional legal steps.
